By accessing or using the Durant Digital website (https://durantdigital.com), purchasing a subscription, or engaging with any product, template, automation, or service provided by Durant Digital—including, but not limited to, Creator OS, Durant Systems, and Durant Designs—you agree to be bound by these Terms of Service.

If you do not agree with these Terms, you must discontinue use of our platform immediately.

2. Use of Services

We provide access to AI-powered insights, templates, automation tools, project management systems, and professional digital services. You agree to:

• Use our services solely for lawful personal or internal business purposes.

• Provide accurate information in all forms and communications—automated workflows rely on your data for timely delivery.

You may not:

• Redistribute, resell, sublicense, or white-label any of our templates, systems, or assets without explicit written consent.

• Use our services for illegal, fraudulent, or harmful purposes.

• Reproduce, modify, or reverse-engineer our content, code, or automations without permission.

3. Intellectual Property & Licensing

All content, templates, tools, automation workflows, insights, and digital assets (including but not limited to Creator OS, Durant Systems, and Durant Designs) are the intellectual property of Durant Digital.

We grant you a non-exclusive, non-transferable, non-sublicensable, limited license to use any downloaded or accessed digital asset solely within your own business or projects.

Reselling, redistributing, or claiming ownership of our materials is strictly prohibited.

4. AI-Generated Content Disclaimer

Many of our templates, insights, blog posts, and automation flows are generated or enhanced by artificial intelligence (AI) and reviewed by humans for accuracy and clarity.

These materials:

• Do not constitute professional advice (legal, financial, medical, etc.)

• May contain factual or contextual limitations inherent to AI outputs

• Should be used at your own discretion

Always consult a qualified professional before making critical business, legal, or financial decisions.

5. Accounts, Payments & Subscriptions

• You may register for an account to access both free and paid offerings.

• Creator OS Subscription ($29/month) grants full access to templates, calculators, tools, insights, and exclusive member content.

• All payments are securely processed via Stripe.

• Subscriptions renew automatically unless canceled before the next billing date.

• All digital products and services are non-refundable, but subscriptions may be canceled or paused with at least 7 days’ notice before the next billing cycle.

6. Automated Service Processes

When you purchase a subscription or service, our systems may automatically:

• Create project workspaces in third-party tools (e.g., Trello, Airtable, Notion)

• Send onboarding and project access links via email

• Trigger task assignments and workflow steps for service delivery

By purchasing, you consent to these automated processes and the transfer of necessary project data to these platforms.

7. Custom Services

In addition to self-serve products, we offer:

• Website design subscriptions (Durant Designs)

• Marketing automation services (Durant Systems)

• Branding, development, and implementation services

Custom work is billed separately and governed by project-specific agreements.

8. Data Collection & Privacy

We collect and process:

• Payment data (via Stripe)

• Onboarding data (via our form tools)

• Project files and communications (via Trello, Airtable, Google Workspace, etc.)

We use this data to:

• Deliver your purchased services

• Automate onboarding and project management

• Communicate important updates and deliverables

9. Third-Party Services

Our platform integrates with third-party services (e.g., Stripe, Trello, Airtable, Zapier, Webflow). While we select reputable providers, we are not responsible for their content, policies, or service availability.

Use of these services is subject to their respective terms and privacy policies.

10. Limitation of Liability

To the fullest extent permitted by law:

• Durant Digital is not liable for indirect, incidental, special, or consequential damages.

• We do not guarantee uninterrupted or error-free operation of our platform or integrations.

• We are not responsible for business outcomes based on your use of our tools, insights, or automations.

11. Indemnification

You agree to indemnify, defend, and hold harmless Durant Digital and its affiliates from any claims, damages, or liabilities resulting from:

• Your breach of these Terms

• Your misuse of our intellectual property

• Your unlawful or improper use of our services

12. Termination

We may suspend or terminate your account without notice for any violation of these Terms.

You may terminate your account by canceling your subscription. Termination does not entitle you to a refund for the current billing period.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of California, United States.

Any dispute shall be resolved through binding arbitration in California, and you waive the right to participate in any class-action proceedings.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or platform notice. Continued use of our services after changes constitutes acceptance.
